ISSUE

Whether a trademark can be registered "Glass Wax" when product does not contain any wax.

RATIONAL

First, the court found that the mark was not deceptive because consumers were not relying on whether the product had mark.
However, the mark was deceptively misdescriptive. Therefore, the court found that the mark could not be registered.
