Harlem Wizards v. NBA, 952 F. Supp. 1084 (1997) p.97supp

SUBJECT

likelihood of confusion

FACTS

P was worried about reverse confusion because the NBA decided to name a team "wizards."

ISSUE

Whether there is a likelihood of confusion between Harlem Wizards and NBA Wizards. Will people be confused that the Harlem Wizards are seen as a spin off of the NBA Wizards.

RATIONAL

Court went through Polaroid factors. The markets are different. The Harlem Wizards is an entertainment, show market and the NBA is a competitive market. The people that are going to watch the NBA are of a higher income than those watching the Harlem Wizards. There is no likelihood of confusion.
