FACTS

Baltimore built new baseball park that was eventually named Camden Yard. D argued that there was no trademark over Camden Yard since they did not sell any goods or services while the park was being built. D sold tee shirts the entire time with the name Camden Yard on the shirts.

ISSUE

Whether the use in advertising, media, etc, established a trademark over name "Camden Yards."
