• The President has absolute immunity from civil liability for his official acts.
  • There is no immunity for the President's unofficial acts, including those he committed before taking office
  • Presidents have a qualified right to refuse to disclose confidential information relating to their performance of their duties (executive privilege). The need for the President's evidence in a criminal trial will generally outweigh the President's vague need to keep information confidential (U.S. v. Nixon).
