plaintiff generates and gathers information at a cost the information is time sensitive the defendants use of the information constitutes free riding on P's efforts the D is in direct competition with P ability of other parties to free ride on efforts of the P or others would so reduce incentive to produce product or service that its existence or quality would be substantially affected
