Also known as an implied trusts. arrise by operation of law when facts and circumstances show that a person had the intent to hold equitable title although legal title is in the hands of another.

Imply trustlike relationship with goal of carrying out person's intent. Examples:

  • failure to create an express trust - if did not indicate trust purpose, descibe beneficiaries specifically, or comply with RAP
  • failure of express trust to dispose of all trust property - could have a trust with too big a corpus
  • purchase money resulting trust (PMRT) - if person who pays the price for proeprty does not receive title but directs title to someone else
