- make sure there is no contrary indication in the will
- must demonstrate a sufficient relationship between survivor and beneficiary
- statute does not apply if they were a friend
- property will pass to descendant of predeceased
- if no descendants of pre-deceased it would go to the residual beneficiaries
- if the gift cannot be saved by the anti-lapse statute, the residual would now pass by intestacy
- if the residual is left to two people, then the survivor would still get it
- do not presume survivorship language except if it is a residual clause (although Court will presume survivorship language if a residual is passed to two people.)
