ORDINANCE #4
WHEREAS, Article III, Governing Body, of the Constitution and By-Laws of the Kashia Band of Pomo Indians of the Stewarts Point Rancheria, as approved March 11, 1936, provides for an annual election of officers, and it is felt desirable to have regulations and procedures governing all such elections,
NOW, THEREFORE, The Governing Body of the Kashia Band of Pomo Indians, the Community Council, herewith ordains the following election regulations and procedures:
I.
ENTITLEMENT TO VOTE
Any adult member, regardless of residence, shall be entitled to vote.
II.
ELIGIBILITY TO HOLD OFFICE
Any qualified voter of the Band shall be entitled to hold office.
III.
ELECTION COMMITTEE
The Business Committee shall appoint an Election Committee who shall conduct the annual election at the November meeting of the Band.
IV.
NOMINATIONS
Nominations for officers will be from the floor at a Special meeting of the Community Council. The meeting will be held at least sixty (60) days prior to election in November. Their qualifications shall be verified by the Business Committee.
V.
ELECTION NOTICES, VOTING LIST, LIST OF NOMINEES
At least 30 days prior to the election date, the Election Committee shall mail election notices to al non-resident qualified voters.
At least 30 days prior to the election date, the Election Committee shall also post in three public places an election notice, list of qualified voters, and a list of nominees.
VI.
POLLING
Polls shall be open from 1-6:00p.m. on the date of the election. There shall be no electioneering within 200 feet of the voting place during the hours the polls are open.
VII.
MANNER OF VOTING
All elections for the election of officers shall be accomplished by the use of secret ballots and 15% of the qualified voters shall constitute a quorum. Any qualified voter may vote by presenting himself at the polls at voting time and by signing the voting register and marking and placing in the Ballot Box the ballot which shall be handed him. Absentee voting shall be permitted but ballots must be individually requested, postmarked, and received prior to the voting time. No proxy voting will be permitted.
VIII.
ELECTION RESULTS
Following the election, the Election Board shall prepare a report of the election and certify to its accuracy and further shall announce and post the results and send a copy of the report to the Bureau of Indian Affairs, Sacramento, California. All election material shall be kept under lock and key for 30 days in the event of a protest or order for recount.
IX.
APPEALS
Appeals from actions of the Business Committee or the Election Board in connection with elections shall be heard by the Community Council at any regular of special meeting, and the decision of the Community Council shall be final. Any appeals or complaints which protest the conduct of an election or the results thereof shall be presented to the Community Council and settled within thirty (30) days following an election, and none shall be considered after the thirty-day period has elapsed.
X.
EFFECTIVE DATE OF ORDINANCE
This ordinance shall supersede any or all other rules, regulations, or customs applied or used which governed elections of officers and shall become effective upon adoption by the members of the Stewarts Point Rancheria.
XI.
AMENDMENTS
The ordinance may be amended by the Community Council at a duly held regular meeting.
CERTIFICATION
We, the undersigned, duly elected officers of the Stewarts Point Rancheria Business Committee do certify that the foregoing Ordinance was Amended by the qualified voters of the Stewarts Point Rancheria at a duly-called special meeting at which a quorum was present on October 13, 1978, by a vote of 34 for and 2 against.
